Account Creation and Service Delivery

When you sign up for an account with SendtoNews we ask for your full name, email address, employer, job title, telephone number, state/province, country, zip/postal code, and a password. We use this information to process and maintain your account request or facilitate the provision of other services you request from us.

For example, we use your email address and telephone number to answer inquiries that you send to us, and to communicate with you when necessary concerning the administration of your account and the processing of your requests. As these functions are necessary to the proper administration of your account and our related services, we do not offer an opt-out from providing your email address and telephone number for such communications.

We use your state/province, country, and zip/postal code information in order to ascertain your location and time zone, which allows us to provide information localized for your needs and interests.

Optionally, we also invite you to provide a street address, a website address, mobile telephone and facsimile numbers. We use this information to answer inquiries that you send to us, and to communicate with you when necessary. We also invite you to submit a corporate logo and / or a personal picture. However, you may elect not to provide any of this information if you would prefer not to do so.

Except as may be required by law or provided herein, we will not use this information for third party marketing or any other purpose.

Email for Marketing Purposes

As a SendtoNews user, you may receive email communications from us that inform you about new functionality or news about our site. You will only receive emails communication after giving consent to do so. You may opt-out of receiving such email communications by contacting us at support at sendtonews dot com. If you do not opt-out, we will use your personal information for these purposes.

Cookies and Web Logs

When you visit the Website, cookies are placed within the memory of your internet access device. A cookie is a small piece of information that a website can store via your internet access device for later retrieval. We use sessional cookies to assist in the log in to your account. SendtoNews uses Google Analytics, including Google Analytics Demographics and Interest Reporting, to help us track the use of our Website.

SendtoNews does not use any personal information while generating this information, nor does it relate any of this information to an individual member or user.

User Rights

Your retain the right to access your personal data and information and be informed on how it is being processed. If requested STN will provide an overview of the categories of data being processed, a copy of the actual data and details about the processing including purpose, how the data was acquired and with whom it was shared, without fee.

You retain the right to have your personal data rectified if it is inaccurate or incomplete. That rectification must be disclosed to any and all third-party recipients involved in the processing of the data in question – unless doing so is impossible or disproportionately difficult.

You retain the right to object to certain processing activities in relation to their personal data carried out by the SendtoNews. In a nutshell, the user can object to the processing of their data whenever the processing is based on the controller’s legitimate interest, or the performance of a task in the public interest/exercise of official authority, or for purposes of scientific/historical research and statistics. The user has to motivate their objection, unless the processing is carried out for direct marketing purposes, in which case no motivation is needed to exercise this right.

You retain the right to obtain your personal data for the purpose of transferring it from one controller to another, without being prevented from doing so by the data processor.

Indemnification

When we are threatened with suit or sued by a third party, we may seek written assurances from you concerning your promise to indemnify us; your failure to provide those assurances may be considered by us to be a material breach of this Agreement. In addition, in the event we are made a party to any claim, suit or action relating to or arising from any services offered by us that is: (a) initiated by you, which is unsuccessful; or (b) initiated by a third party, who Is suing you; you will reimburse us at a reasonable rate for all personnel time and expenses expended by us in response to such claim, suit or action including without limitation, all attorney fees and expenses incurred by us with respect to such response. This defence and indemnification obligation will survive termination of this Agreement and your cessation of use of the Website.

Governing Law and Courts; Timing of Claims

This Agreement and your use of the Website will be governed by and interpreted exclusively in accordance with the laws of the Province of British Columbia, and the federal laws of Canada applicable in British Columbia, excluding its conflict of laws rules and all private international laws. You irrevocably consent and submit to the exclusive jurisdiction of the Courts located in the Province of British Columbia in all disputes arising out of or relating to your use of or inability to use the Website, the services and this Agreement. You agree that any claim or cause of action you may have arising from, connected with, or relating to this Agreement, the Website or our services must be commenced in a court of competent jurisdiction in the Province of British Columbia within six (6) months after the claim or cause of action arises, after which time the claim or cause of action is forever barred.

Severability

The terms of this Agreement are severable. If any provision of this Agreement is determined to be unenforceable or invalid, then such provision will be enforced to the fullest extent permitted by applicable law, and such determination will not affect the validity and enforceability of any other remaining provisions.

Other Jurisdictions

Use of the Website and consumption of the services is unauthorized in jurisdictions that do not give effect to this Agreement or where access to or use of Website or the services may be illegal or prohibited. Those who choose to access the Website or use the services from such locations do so on their own initiative, at their own risk and are responsible for compliance with local laws, if and to the extent local laws are applicable.

Waiver

No consent or waiver by either party to or of any breach or default by the other party in its performance of its obligations under this Agreement will be deemed or construed to be a consent to or waiver of a continuing breach or default or any other breach or default of those or any other obligations of that party. No consent or waiver will be effective unless in writing and signed by both parties.

Enurement

The provisions of this Agreement will enure to the benefit of and be binding upon each of SendtoNews and its successors and assigns and related persons, and you and your heirs, executors, administrators, successors, permitted assigns, and personal representatives. You may not assign this Agreement or your rights and obligations under this Agreement without the express prior written consent of SendtoNews which may be withheld in SendtoNews's sole discretion. SendtoNews may assign this Agreement and its rights and obligations under this Agreement without your consent or notice to you.

Survival

The provisions of Sections 4, 6, 7, 9, 10, 11, 12, 13, 14, 15, 16, 17 and 18 will survive termination of the Agreement, howsoever occasioned.

Entire Agreement

This Agreement, together with those documents incorporated or referred to herein, constitutes the entire agreement between you and SendtoNews relating to your use of the Website and supersedes any prior understandings or agreements (whether electronic, oral or written) regarding the subject matter, and cannot be amended or modified except by the express and explicit agreement of SendtoNews to modify this Agreement in writing, or by SendtoNews making such amendments or modifications available to you pursuant to a modification of this Agreement as permitted herein. No SendtoNews employee or agent has the authority to vary this Agreement.
